Recent developments and what to watch
- 2026-10-08:The AP started its TCA directorate. It expects additional AI Regulation market-supervision tasks and closer AP-RDI cooperation.
- 2026-07-08:The Raad van State's division issued its consultation response on the UAIV.

Key instruments
- Uitvoeringswet AI-verordening (UAIV), the AI Act implementation act. Draft published 2026-04-20 and still a proposal. Ten existing market-surveillance authorities would supervise AI in their own sectors; the AP would become the supervisor where none exists, with a dedicated AI board member; and the AP and the RDI would coordinate.
- Raad van State response(Administrative Jurisdiction Division, 2026-07-08). It addressed supervision of the judiciary's own AI use and advised an exemption from the joint sandbox in article 4.1.
- AP's TCA directorate(from 2026-10-08), the successor to the earlier DCA, in effect as an organisational step ahead of the Act.
Scope: who and what is covered
Once enacted, the UAIV would settle who supervises AI systems in each sector in the Netherlands. The timing of application of the underlying obligations is controlled by the EU Digital Omnibus on AI, which deferred the high-risk deadlines.
Compliance and enforcement
Until the UAIV is enacted, businesses should follow the EU AI Act directly and expect the AP to take on market-supervision tasks for AI. The AP's new directorate signals closer cooperation between the AP and the RDI. The AP also led the EUR 824.99 million Uber finefor automated individual decisions (2026-08-24), showing active enforcement of existing data-protection law against automated decision-making.
Caveats.The date on which the bill will be submitted to Parliament is unknown. The government's 2026-04-20 release was unreachable (404), so the consultation page was used instead. Research assistance, not legal advice; verify before reliance.
